Human rights lawyer, Ebun-Olu Adegboruwa, has asked a
Federal High Court in Lagos to nullify the appointment of Mrs Amina Bala Zakari
as the acting chairman of the Independent National Electoral Commission, INEC.
Adegboruwa, in his originating summons brought pursuant to
Sections 154 (1),(3), 155(1)C, 157 & 162 OF the 1999 Constitution of the
Federal Republic of Nigeria, said Zakari’s appointment was in flagrant
violation of the Constitution of the Federal Republic of Nigeria, 1999.
Joined as respondents in the suit against Zakari is
President Muhammadu Buhari, including Attorney-General of the Federation and
INEC.
In affidavit in support of the application, Adegboruwa
stated that Zakari is not qualified to claim to be acting chairman of INEC as
she was not appointed in line with the provisions of the 1999 Constitution.
In particular, the human rights lawyer contended that her
stay in INEC expired on July 21, 2015 and same cannot be renewed by the
President via a letter, without consultations with the Council of States and
without confirmation of the Senate.
